CN is suing a Kamloops BC based trucking company and one of its drivers for $300,000 in damages as a result of a 2003 grade crossing accident 50 km west of Jasper, Alberta. Several cars were de-railed in the accident.
CN claims negligence of the driver and his employer in its BC Supreme Court action.

About time the railways went after these people who insist in trying to beat the train.
Good for CN. The other railroads should start doing this too. I also think thay should start trying to recover costs related to lost time in other collision cases too.
Some of you may remember that just a couple of years ago two teenagers were playing on top of some freight (or passenger) cars in the Northeast Corridor. One of these idiots fell off after touching a catenary wire and was injured.
The parents then sue Amtrak! These idiots should have been locked up for trespassing and the parents should have been locked up as well.
NS started doing this sporadically several years ago; hence the reason for the cameras in the locomotive cabs. After years of settling out of court with these idiots, the RR’s gave every Tom, Dick, and Harry who got into a grade crossing accident the idea that the RR was immediately to blame no matter what, and sued. I guess the railroads finally figured out it really is worth the lawyer fees to take these Darwin Award nominees to court and sue them for property damage! Way to go CN!
That’s an interesting tactic. Hope it works out well for them. It is amazing how people who get injured while tresspassing on private property think they can sue and somehow get rich doing so.
CN RAIL HAS FILED A LAWSUIT AGAINST OMER DESPINS TRUCKING OF KAMLOOPS AND ONE OF ITS DRIVERS OVER A DERAILMENT IN 2004. THE COMPANY IS SEEKING 300-THOUSAND DOLLARS IN DAMAGES FOR THE INCIDENT IN WHICH A TRAIN COLLIDED WITH A DESPINS TRUCK DRIVEN BY PAUL VANDERGUCHT AT A CROSSING 50 KILOMETRES WEST OF JASPER, ALBERTA. OWNER OMER DESPINS WAS ONLY INFORMED OF THE LAWSUIT WHEN CONTACTED BY TV-7. THE COLLISION LED TO SEVERAL RAILCARS LEAVING THE TRACKS, CAUSING SIGNIFICANT DAMAGE. THE LAWSUIT CLAIMS THAT THE COLLISION WAS CAUSED BY THE NEGLIGENCE OF VANDERGUCHT.
