Court: Railfans have “right” to take pictures on NYC subways

Glad they took this all the way to a published court decision.

Bravo! There should be NO place in the USA for laws/policies that rely on paranoia to provide security!

To have a big pr event and then cite folks for taking pics? Not everyone got the memo

Well done on behalf of all railfans. Too many “jobsworths” around these days - we have plenty of them here in the U.K. as well. (Trying to enforce laws that do not exist).

I hope the news spreads far and wide!

ONE NIGHT LAST YEAR, TAKING VIDEO OF A TRAIN, THE LOCAL POLICE OFFICER OF THE SMALL WEST TEXAS TOWN TOLD ME I COULD NOT TAKE PICTURES OF THE TRAIN, HE SAID IT WAS ILLEGAL. I ASKED WHY IT WAS ILLEGAL…HIS RESPONSE===THE GOVERNMENT OWNS ALL RAILROADS AND IT WAS ILLEGAL TO TAKE PICTURES OF GOVERNMENT P;ROPERTY=====I JUST LOOKED AT HIM, TURNED AROUND, LEFT, WENT TO ANOTHER LOCATION. KNEW ANY ARGUMENT WOULD BE FUTILE.

It all comes down from the “top.” TSA is out of control in using common sense and so are the enforcement officers who are so afraid to make a common sense decision they err on the letter of the law (or one they are making up–you do not have to present ID to an officer on the streets unless he arrests you. In a car yes, street no!) They have a real tough job but they only are making it harder when they become arbitrary, case goes to court and they lose. Loss of respect. Too bad.

May I remind JEFFERY GUSE that it was a republican government that brought us this sort of harassment and paranoia. So please stop bothering us with that socialism rubbish. This is about trains, not politics. Thanks.

For once the right thing has been done, when a nation makes suspects of it citizens it is not a good sign, we need to constantly remind those we select to represent us that it is “we the people”
and we are not the enemy, and we should be treated as good if not better then the elected, although the elected seem to think and act as royalty.

What about all the other stupid socialist laws in NYC? Get rid of one and there are hundreds of thousands of others still on the books. All in one city.

Great job thanks for helping other railfans

It is about time!! I was first stopped in 1969 and told about photo permits. Some jerk flashed a flashbulb and some passenger sued the transit agency. Now we are in the digital age where flashbulbs are not really needed.

My real problem with some (perhaps only a few) officers is not that they are mistaken about a law they are trying to enforce - it’s the attitude and disrespect they give to the public.

The only times I’ve been asked to stop photography, the officers involves have been very polite and respectful - no problems at all.

Well put Mr. Nelson. Let’s all be helpful and respectful enthusiasts and do our part too.
