Court throws out suit against All Aboard Florida

Not sure what other strategies are in the NIMBYs toolbox, but this does put a dampener on almost any procedural motions against any kind of funding for the project.

Previously the counties (well, Indian River) had hinted at using their ownership of the crossing equipment to make it harder for AAF to upgrade them, as required by a DoT mandate. But I would imagine the FLDoT would intervene if that happened, and I’m guessing AAF would run trains at a slower speed (maximum 70mph rather than 110) through the offending counties if they were forced to choose between that and no service at all.

Glad to hear about All Aboard Florida’s victory in the court. Trouble is, I doubt the NIMBY’s are through yet. Like most spoiled brats they’re going to clench their little fists, stomp their little feet, throw their little tantrums, until they either get what they want or give up and go away.

Only time will tell.

I guess the NIMBYs want to just keep bawling about congested highways and cry for the Government to bail them out. AAF is a private venture, could that be part of their self-induced heartburn?

I hope there are no stations planned in those counties. I would hate to see them reap any economic benefits from the rail line after taking the NIMBY’s side. Let them sit in gridlock as the train speeds by at 110 MPH.

Lee Rife: Not likely. These people are nothing if not well organized and tenacious. Sometimes their victories come not in a court decision, but by delaying, hence increasing the cost of, any project, to the point where the entity that was doing the project just decides it’s not worth the aggravation. Hopefully, though, this decision will slow down the NIMBY crowd, though the BANANA’s-Build Absolutely Nothing Anywhere Near Anything-will probably also be heard from. If these people lived in the Ice Age, we’d all still be living in caves.

We railfans don’t get a lot of victories in the legal system. This is one to celebrate, and hope it sticks.

@CHRIS DUPREY - I live in one of those counties, so I hope you’re wrong. I would like to see these jackwagons kicked out of office first though.
