I believe this was a case where the UP hit a woman in her car. It was clearly her fault, but she was awarded damages in court. We have discussd that case here on the forum, back when it was in the news.
I will tell you what, this sounds exactly like the “Choking Game.” I have heard about it so much, (my aunt is a cop). She is also really upset about the people who blame the railways for the persons own faults. We have not had any big RR related incidents around my area, but there have been plenty I have heard about.

It could take you seconds to see if a train was coming.

I agree it was the girl’s own fault. This sort of thing is to be expected. Personal injury lawyers always look for the “deep pockets” when an accident happens, even if they weren’t at fault. Many companies are willing to pay out nuisance money rather than go to court. I wonder if the girl was listening to an iPod at the time. If so, the horn signal would have be drowned out.
Also, if this is such a dangerous crossing (near the high school, poor sight lines, etc.) as someone suggested, then the City of Cuyahoga Falls should build a grade separation.
Every year, some idiot here in Pittsburgh gets hit by a train. They won’t wait for the gates, and walk (or drive) around them with predictable results. My feeling is, if you’re that stupid, you deserve to get hit. You also deserve nothing.
the thing is the girl was a normal kid from what i can gather. the thing is not who’s to blame. not every incident involves blame. this was an unfourtanate accident. it does not entail the general public is stupid, or the girl was. i’m sure she just didn’t see it coming. Too put blame on her is a red herring and ad homenon. look at the forest instead of the tree. it’s not about who’s right or wrong, blaming people doesn’t bring results and complaining here won’t change anything. this is not an attack on anyone and it is written with a kind heart and great respect but it is the truth.

Maybe not a grade seperation but maybe gates across the sidewalk would have helped a little, and i’m sure they will be discussing grade crossing saftey at school. I’ll get the low down from my neighhbor who’s a cop for the city, i just hope he wasn’t on duty that day.

Am I sorry for the death of this young person, YES. Having said that, I must add that the egg throwing incident does not surprise me at all…STUPID PEOPLE WILL ALWAYS BLAME OTHERS FOR THE ACTIONS OF OTHER STUPID PEOPLE, AND NEVER THE STUPID PEOPLE WHO WERE REALLY TO BLAME…PERIOD!

One of the problems here is that of “familiarity breeds contempt”. The railroad crossing is so close that kids go over it every day and part of their brain shuts down. It happens for adults to, like the school bus driver in Murray County, GA who drover her school bus over railroad tracks. Now for her it doesn’t matter whether the railroad had a stop sign, lights, bells and gates or fireworks exploding; her school bus driver’s manual specifically stated - as it does for school bus drivers everywhere - that the bus must come to a halt and the driver look both ways before proceeding. One of the nicest elderly men I ever knew was responsible for that law in Georgia because when he was a high school senior driving an early school bus, he failed to stop and didn’t see the ACL steam locomotive approaching.
Part of the problem is that railroads are such low profile businesses these days. Groups like my Georgia Association of Railroad Passengers might put on safety programs at schools to remind youngsters of the dangers inattention cause around railroad tracks. They should probably also give such talks to clubs such as Lions, Rotary, etc.
Back to Murray County, Ga, I covered a car train accident in which a boy and girl were killed after trying to beat the train. I don’t think there will ever totally be an answer for stupidity such as this, but they do need to be reminded occasionally.

In1990 in Streator IL we had something simalor happen. A group of teenagers thought the could beat the train across the crossing and falied the train was the 199 of the ATSF and it was not a pretty sight. I hate it when someone is so stupid to cross in front of a moving train or cuts off a semi so they can make their exit. Simple physics states the larger force wins everytime. 4000 tons verys maybe 1/8 of a ton or in my case 15 tons I was empty versus 2 tons who wins. I also was sued after my accident and had my assets frozen til my atty got them freed for me. I have sated it in the past and am saying it a again if you are at fault in anyway of an accident you lose your ability to attempt to recover any damages in a lawsuit.
