Between Enright and Timber the line goes through what has been state forest land since a devastating forest fire many years ago. However, there will be less flood damage as they work their way inland to the summit at Cochran.
My issue is the judge’s logic.
Maybe, this is a free-ride ticket for him, nobody presented the history of the pre-damaging storm Tillamook Branch in evidence.
But, if he’s saying that because since the crippling damage to the right of way nothing has moved to demonstrate interstate commerce (apply your own cliche, or other terminology)…Dude, Give us a break…Dude, Take a break…Dude, apply your "stupid’ brake…big hole it.
First, new construction was attacked by the environmentalist wackos. Now, it appears repairs are as well.
Tillamook got some FEMA money to rebuild the connection to the outside rail system, but when they saw how much it would have cost, they got permission to use it for airport expansion instead. POTB has shown they have no plans to re-establish connection. Even so, railroads are not exempt from environmental laws. Anyone needing to do dirt work along a river needs a permit to show their erosion control plans are adequate. Oregonians don’t like it when you screw-up salmon spawning habatat.
This group has accomplished a lot in only 2 years of rebuilding from the 2007 floods. Once they get to Enright I hope they can lease all the way to Timber. Looks like there are some neat bridges and tunnels on that stretch.
Hope you beat what in my opinion was a BOZO ruling.
wtf. this judge is stupid. the rai railroad is the agent. they have done nothing wrong!!! they are the tenients who claen reapir and make shure the railraod is in great shape. which they have done. in fact they made it better!!! man what the heck.
