First lawsuit filed in Lac-Mégantic incident

The engineer should be left out of this. Its not fair to him. He hasn’t even given testimony. By the way Ed Burkhardt, was quick to blame the engineer. There is something much deeper to this story, that we won’t ever possibly know! Those who are quick to point the finger. Are hiding something, to cover up their own tracks…

You can always count on the ambulance chasing lawyers. Able to arrive at the scene faster than anybody else.

As for hauling hazardous materials by rail with minimal crews and leaving the contents unattended outside of secured yards, those days will be coming to an end very soon.

If anybody should be sued it should be the party responsible for the for the emergency response team in town were the the train was secured, if they had used some sense and stayed at the sene until RR people had arrived this whole mess could have been avoided. After all when the engineer found out about the problem he was able to detach several cars from the wreck and avoid more destruction!!

Why did the train runaway? I thought if the train line air pressure was lost, the brakes would be on. Obviously I was wrong.

I was impressed that the chairman of MM&A had the courage to go to Lac Mégantic and meet the citizens.

@GOOSIE - If someone can’t sue over something like this, exactly what do you think they should be able to sue over?

@RON VANDERBURGH: Railway air brakes “bleed” over time when engaged, and eventually lose their effectiveness if not recharged. The engineer left the engine running in order to keep the brakes charged, but the engine was switched off after a fire broke out. Some time after the engine was turned off, the air brakes would have failed.

Yes Mr. Vanderburgh, but he was 5 days late and a dollar short. Universities and PR firms in The US and Canada have stated that this will become a case study of how NOT to state your case. He came to a Francaphone community and did not bring a translator, spoke to much and left his brain in Chicago. Mr. Burkhardt single handedly put the railway industry back 30 years.

Further, Please do not compare the MM&A to the other railway in Canada that uses single man crews (QNS&L) as you are comparing apples and oranges!

I understand it is a tragady and all, but accidents happen ALL the time with ALL modes of transportation. The whole sueing thing is getting out of control. But I guess money fixes all for some people. It is of course someone or somethings fault albeit, faulty equipment, the crews fault, some kids knocked hand brakes off…etc. Nobody knows and all the conversations on here are getting out of the subject also. And for the public and news people, CRUDE OIL DOES NOT JUST EXPLODE, it had to rupture a gas line under the ground on top of the derailment site to spark the explosion. So for all the people making comments about they shouldn’t run these trains and all the NIMBY groups, the railroad was most likely there before you moving in and encroaching upon it. I see all the NIMBY people as self absorbed mindless idiots! If you do not graspe this you are uneducated and need to learn more before making assumptions. Then when you pay more for things because they have to use more trucks or other means because you didn’t want a train running by your house, don’t complain about it because you were at fault. I hope you will someday realize that rail transport is one of the safeist modes of transport for most hazardous chemicals and commodities. Alot of the things shipped by rail (and there are THOUSANDS) of these shipments every day everywhere, cannot go by highway due to them being so dangerous, so it goes the safeist way, by rail. Again all the railfans on here making comments because they can watch trains all day and play with theirs under the xmas tree, need to go home and play with their train sets…it will be alot safer for you there…

While I agree that the people have the right to sue, I think that they should wait until the results are in, in order to sue the right people. As for the engineer I hope and pray that he is found not guilty so he can tell his boss to take a long walk off a short pier and then sue him for slander! This is a family blog so I have to keep it clean.

If it was your family blown up in that town you would be sueing as well
