Florida requires ROW "No Trespassing" signs

I found this story in the Miami Herald today. Is Florida the only state with a law like this? Can’t the railroads turn around and play the “interstae Commerce” card?

Count the holes in the fencing cut by vandals or trespassers long the ROW. There will be sufficient cause to arrest em. Hopefully you catch em on a moving railcar so you can shake em a little bit.

I don’t know if it’s a law or not but the CN tracks I’ve seen (99%) have blatant NO TRESPASSING signs on them.

Different states have different rules on trespassing. Many say you have to post signs every such-and-such a distance, say 100 yards. Colorado used to have a quirk that required an owner to close off an area for at least one day a year or face declaration of public access. Virginia skirted all this and simply passed a separate law making it a felony to trespass on railroad tracks or yards. In this case the RR doesn’t have to file a trespassing complaint at all. If a Virginia peace officer sees you on the tracks, he can apprehend you, period.

In every town I’ve been in that Canadian Pacific has had trackage, they have had signs saying to effect that this is railroad private property. The only place I’ve seen this enforced and with regular patrols is in Calgary, Alberta. Other than that it’s been open for people to walk through.
