Graffiti paint sprayer killed by passing train

I saw the article below and I’m surprised that this doesn’t happen more often. I don’t feel to sorry for this vandal (but I feel bad for the crew that hit him). My guess is that these idiots have to use ladders or something to make these big eye sores, and it’s a surprise that they don’t fall or get hit more often. How often to you RXR employees see these artists (I use the term loosely)? Are some of them caught by the RXR police?

TORONTO - An 18-year-old trespasser was hit and killed by a Canadian Pacific freight train Tuesday evening as he spray-painted graffiti on a boxcar in the west end of Toronto, accorded to a story from CBC news. Police said the man was hit by the passing train traveling about 25 mph about 9:45 a.m. on a parallel track as he and two friends painted the car. The victim died en route to a hospital. His name has not been released.

Sad, but it was comming to him.

So is it different in Canada, is it the fault of the vandal for being in a place he shouldn’t have? Or is it like it is in America where its the fault of the railroad for not having taller fences to deter a vandal, and of coarse his family will sue the railroad, the boxcar manufacturer, and maybe even the police for not stopping their son from doing this.
I know this has been covered before in other forums, I am just curious from the members who are north of the border how their society views a tragic event like this.
