Quick question if a train crew times out on HOS before they reach the yard do the get paid for the time it takes for a van to pick them up and bring them back to the yard? Finally are pool crews determined by seniority? Thanks and be safe.

Yes. On a unionized property everything is determined by seniority. Pool jobs are put up for bid when the pool is expanded or when there is a vacancy. Anyone can bid. Highest seniority that bid gets the job. Mac

Crews, under most contracts, remain on pay until they register off at either their origin or destination terminal. They are relieved of responsibility for their train when the go HOS. The time between going HOS and finally registering off is called ‘Limbo Time’. When registering off, the accumulated Limbo time must be added to their statutory 10 hours undisturbed rest period, before they can be called for their next duty assignment. If due to weather conditions, a crew is taken to a rest facility that is intermediate to their origin and destination - they are paid for the continuous time that elapses between their origin and destination…ie Called on duty at Richmond-Philadelphia run - blizzard hits the Mid-Atlantic states and crew is taken off train in Baltimore and sent to a Baltimore hotel … 12 hours later they are called from Baltimore and complete the trip to Philadelphia…They are on pay from the time the were called at Richmond to the time the register off at Philadelphia…The time at Baltimore is not considered Limbo Time as they were at a rest facility.

The Texas Eagle appears to have a unique situation. At Austin the engineer gets on the southbound train or off the northbound train to drive the train between Austin and San Antonio. At the end of their relatively short runs, irrespective of the direction, a van takes them back to their point of origin. Would the engineers be paid for the van trip?

Most likely paid round trip mileage for the trip. Don’t know what the mileage between the points is…it could all be covered under the mileage for a basic day.
