if it doesnt tell me something i wont listen.

i think that the law of no trespassing on the tracks is a law for good reason but i dont find any signs that say that i cant trespass. IF IT DOESNT SAY NO IT MUST MEAN YES. kinda thing plays in to that a bitbecause i believe that they should have a sign up that says NO TRESSPASSING UNDER PENALTY OF LAW but i have personaly never seen one at any crossings?

Anyone think that they should put those up?

Im not gonna say i never walk the tracks i do it many many times. It is much safer than walking on the side of the road where someone could swirve and hit you and the train of many odds will not be coming and you will hear a horn long before it comes so you would be fine(most of the time)

any ideas, comments, or corrections?

With the absence of a ‘No Trespassing under Penalty of Law’ sign…let me come in your house and rummage around to my hearts content!

As BaltACD posted above, you are pretty much incorrect. Private property is private property, you don’t need a sign to tell you that.

It’s because of folks with a lack of common sense that they have to put up those signs in the first place. If everybody used a little common sense, there’d be a lot less signs, and not to mention a lot less lawyers…

Both are trespassing. One just happens to carry a slightly steeper penalty.

You don’t have to enter my house to be trespassing on my property. You may just be taking a shortcut across my lawn.

Either way, you are showing a profound disrepect for me and my property.

I won’t bother including any of the multitude of news stories about people who were walking on the tracks and didn’t hear the train coming. In some cases, at all.

What we have here is some people who don’t seem to feel that the principle of private property applies to them (unless it’s their property). Try as they might to justify their past or future actions, all of their arguments come back to one thing - they are on private property without the permission of the owner, and are therefore trespassing.

well i mean that because of all of the idiots out there (me included in some instances) i can see the reason why they should put the signs up though, yes indeed common sense is involved (some individuals do not have it) that you should have respect for the railroad. I have much respect for anything that can flatten me out and not even know i am there, i just like the shortcut to anywhere. But i know that it is wrong and i am sure that railroads frown on that. But i should stop before i get myself in some trouble somewhere along the line(get it!).

Im sort of on both sides here. Mainly because if there is no “no trespassing sign” and it is private property and your not aware its private property, you should be in no trouble because there isnt a sign. On the other hand, if it is private property and you know just stay away.

If you think they’re the same, try entering someones house without their permission. I doubt very much you’ll be charged with tresspassing. You’ll more likely be charged with breaking and entering and that’s assuming someone doesn’t shoot your sorry butt. In most states, you cannot be charged with tresspassing unless there is a NO TRESSPASSING sign posted or if there is no sign posted, the property owner or someone with their authority asks you to leave and you refuse.

Lets just put it this way. If i walked onto someones property that didnt have a NO TRESSPASSING sign and i got seriously injured. I could sue that land owner and get quite a bit of money for it. Hey, i need to pay the medical bills from the injury that happened on your property, plus i need money for emotional stress and what have you.

The same thing happened to some friends of mine. The neighbors kids walked onto their property one day and they climbed the side of their garage which happened to have a pool attached to the side. The pool had bug nets surrounding it and they decided to walk on top of the nets where one of them fell through and broke his arm. They sued my friends family and won. They got money for the medical bills and had some leftover.
