JMRI won its copyright appeal in Federal court, thus returning the case to court in California, which must make another ruling. My brother saw it on slashdot and sent me an email with this link:

It’s getting quite a bit of publicity, inlcuding the Wall Street Journal and the New York Times.
Here’s the ruling: http://www.cafc.uscourts.gov/opinions/08-1001.pdf
Here’s JMRI’s view: http://jmri.sourceforge.net/k/updates.html#last
The battle is by no means over, though.

Remember the Law of the Louis L’Amour West?: “We hang rustlers, and shoot horsethieves.”

Unfortunately, like many other cases this is likely to drag through the courts until one side or the other goes bankrupt and gives up.
Here’s an interesting comment from the Slashdot page …
Katzer went and got patents over the concepts expressed in JMRI, which were only granted because he failed to disclose JMRI’s prior art to the patent office, and then sued the JMRI people for infringement of their own code!
Matt Katzer’s a local Portland, OR boy (I’m also in the Portland area and I know Matt) - and all I can say to him is “oops!” [B)]

That’s my reading of the case, too. Apparently he’s vacated some of his patents, but this looks like it’s going to be long slog anyway.

“Oops” is putting it lightly. While I like Katzer’s software, especially the ability to use a wireless PDA as a throttle, I will never purchase it because of his underhanded tactics.

Do me a favor and walk up to him and say “this is from WaxonWaxov” then kick him in the nutz.
Wouldn’t do much good. Like many of those who “have to have the very best,” he spent a lot of money to get them in brass.
Ah drats, deleted again. That’s what I get for mentioning…oh well you know. [;)]
Anyway, I DO think a blow was struck for the little guy in the JMRI case.
