Legal question about Gunn firing

The law says the Amtrak board must have 7 members. Right now there are only 4. Can they legally fire him?

Can the House Commitee of Railroads reverse the firing when it meets on Novemeber 15th?

Technically the could not fire him. He was a board member and could not vote since it invovled him and they did not have a majority of the people who are on teh board there. MIneta had to be there to acctually count his vote and since he set a DOT layer he was not there and that left 2 people well short of 4 don’t you think

Gunn was not a member of the Board. Making the Amtrak President a member of the Board is part of the Senate reauthorization bill passed but not yet law. Maybe the action was not legal, but the question is moot as far as his return. Trust me, there aren’t enough horses to drag him back. On the other hand, the situation might mean that he will continue to receive salary. Don’t worry, he knew exactly where his position on the Amtrak issues might take him.

This whole Gunn firing thing reminds me of a sports team that has a losing record and fires it’s coach. Detroit and Kansas City baseball come quickly to mind. Those guys don’t want their jobs back either. Who needs the headaches.[swg]

David Gunn came out of retirement to lead Amtrak and he will go back to retirement, he will be fine. It will be Amtrak that suffers the fate.

And isnt it against the law to discharge a gunn on company property?

Yes, the wrong person was fired…we had a chance in the 2004 election to fire the real culprit and failed to get it done. Now Mr Gunn and AMTK will pay the price for that earlier misfortune.
