More sparks fly in Canadian rail battle

Yes HH made money for CN, but at what cost? CN had three pretty serious derailments in Alberta just last week. Hinton, Hay Lakes and Wainwright. Wonder how CP’s safety record will be if HH takes over???

Hunter cut upkeep of infastructure to make the bottom line look good for share holders. We can see what this has done and continues to do, bad track, bridges etc result in many more derailments than other class 1 railways.

Just what was Hunter’s agreement with CN? That should be simple to resolve. Do the vultures have a different play-book?

In Canada, as in the US, the common law rule concerning non compete agreements that they have to be reasonable in time, scope, and geographical limitation. An agreement not to work for a competing law firm in Denver for a year is probably ok, but preventing a plumber from following his trade anywhere in Texas is unreasonable. In Hunter’s case, there are only two Class I railroads in Canada and this might be considered unreasonable. But don’t take contract law on the say-so of an old curmudgeon who lives with his cat.

I think he had an anti competition clause for a specified time period after he left CN.

Looks to me like CN just resolved it!

And in Ontario his laissez-faire attitude towards track caused the CN to lose face. Frozen switches on commuter lines is not a way to make friends!

CP’s just a wooden-axle outfit compared to CN, and it’s high time somebody noticed and put pressure on them to get up to snuff.
