Word on other forums is MTH has won a 27.9 Million dollar judgement against MKT and then Korean Brass over the Lionel issue. It is a long story which I don’t fully understand but to put it in a nut shell, all payments made to KB and MKT will go directly to MTH until the judgement is settled. These companies make trains for BLI and the opinion is that this will cause KB and MKT to not deliver trains to BLI because they won’t receive any payment for them. Don’t know how it will end up but it seems the general opinion is that BLI may be history. I surely hope not, I am still waiting on my SP GS4 and passenger train.
Where did you read this. IIRC, a while back the judgement against Lionel was set back or reduced. Trying to collect from China may be a problem. Who would intercept payments to these two companies and direct them to MTH? The two companies can just create new train entities and continue on with business.
Lawsuit was filed and judgement given in the US, Michigan I think but not sure. Hot topic all over the O Guage Railroading Forum. From what they say there is a treaty between the US and Korea concerning this type of court case and the verdict is honored by both countries.

Guy under rock has a question. What’s going on? Who’s MKT ( keep getitng hung up in a bought out by Union Pacific) and how is O scale going/not going to nail an HO manufaturer such as BLI

I’ll take a stab at this. The 2 companies getting sued(KB and MKT) make stuff for BLI. (regardless of scale) If the courts are redirecting any payments they have coming in to MTH, then how will they(KB and MKT) be able to make trains and sell them to BLI?(Right?)
These court deals usually aren’t enforced so harshly that they would force the company into bankruptcy or out of business. Everyone loses if that happens.

Lothar that is the point exactly. Scale doesn’t matter. The judgement is against KB/MKT who make trains for all scales and various companies. Point is nothing gets made by them, for O or HO or N for that matter.
The BLI/MTH case goes back several years; Mike’s Train House claims that Broadway Ltd. violated an MTH patent by using Back-EMF “cruise control” in their first run of Hudsons back around 2001-02. BLI removed the BEMF from later trains until the case was settled a couple years ago.
MTH later started a separate suit against Lionel, IIRC claiming that a Lionel engine was an illegal copy of one MTH was going to offer. AFAIK BLI wasn’t involved in the Lionel action at all?? I guess it’s possible Lionel HO and BLI HO might have been made by the same manufacturer in Asia.
What are you all talking about other than two companies owe money to another? What did those two companies allegedly do which caused this disturbance? Fortunately, I don’t believe I’ve been a consumer of any of these companies’ products, thank you.
