Imminent domain to help a private interest. That is just awful. I wish SCOTUS put a stop to this when asked to review such a case.
The Supreme Court got this WRONG. Taking private land for commercial development is not in the public interest. The fact that a railroad was a victim of this law is ironic considering some of shenanigans rail barons pulled.

SCOTUS supported stealing private property to give to others expected to pay higher taxes in the KELO decision. It’s been downhill ever since.
Ironic indeed, since most of the eminent domain seizures in recent decades have been for railroad construction and/or expansion. I have a hunch that NS didn’t know they owned the land at all, until someone told them.
This sounds similar to the Kelo case in New London, CT where a woman’s property was taken away for the"public good". The courts ruled that a developer bringing in more tax revenue for the city amounted to the “public good.” Ironically the property was never developed and it sits as vacant land.
Just another example of run-a-way, arrogant, stupid government.
Or could it be another example of runaway, arrogant corporate greed? Just this time they are stealing from each other.
This situation sounds like possible?? sloppy legal work on the part of the Delaware DOT— serving the wrong entity with the lawsuit for ED. In order for the Court to obtain jurisdiction, the proper corporate entity related to the NS property at issue must be served with the summons. I cannot see how counsel for whomever DOT served could fail to notice the possible lack of proper service of summons. That is the first thing an attorney who is half awake should check. Maybe this is why NS did not know about the ED seizure. Maybe NS has already checked this out.
