It’s garbage; it’s short 3 assemblies and has a broken piston; in no way could a court declare it properly preserved evidence and permit it to be a witness to what happened that night of tragedy.

What would the Canadian Police do with 5017 if they had it? Is there some evidence on it they want to collect?

Im surprised the locomotives involved in the accident haven’t been impounded since the event. They’re evidence in a death investigation.

Guessing they don’t want the risk it’ll be unavailable before the end of the trial of Harding et al in case some kind of previously unthought of theory about the disaster needs investigating.

Another sad example of emotion and poor police work on the part of the Canadian authorities. The engine has not been secured (impounded) since the tragedy, and it’s value as evidence is severely compromised. What do they intend to do with it? Recreate the events of that night? Unlikely. Use it to sway the emotions of a jury is a more likely motive.

Why hasn’t the information that was found on the event recorders of the locomotives involved been made public? While there is probably little if anything on the 5017 that would be needed now for determining the cause of the train running away, if the locomotive had not been impounded and secured there has been no chain of control so that may make any evidence found now inadmissable in court. All testing and investigation on the 5017 should have been done immediately after the wreck under court control by the required authorities.

The Kanadian Keystone Kops are in action here. If the loco had evidentiary value, the Surete should have it impounded, and there would be no discussion of this now. After all this time, the forensic work on all the engines should have been done, and any/all conclusions have been reached.
