Railfannig Habits

I sit there waiting for the train with my camera or just wander around. I never go on private property though and I always stay well away from the tracks whenever there is any railroading equipment around even if it means that I don’t get a picture. I have only been approached by a cop once while I was railfanning and he just wanted to know why in the world I was waiting for a train (I think he thought that I was a bit wierd).

Did you consider notifying NS local authorities about this incident? That guy seemed to be way out of line when you were not apparently on NS property and not even photographing trains. He may have been trespassing when he left NS property to come after you. Such excessive behaviour gives railroads a bad image and their management deserves to be notified of the behaviour of a very small percentage of their employees.

I call on your post.

It might have been a rules infraction too–violation of rules 1.6(6) and 1.6(7).

I will admit–I go on private property (usually the railroad’s), and I get close to the trains. Only one day have I been asked to leave. Usually, the railroaders don’t mind and go about their business. If they ask me to leave, then I do.

I always thought it might be neat to buy a patch of land by the tracks to railfan from. A mean policeman would be taken aback when he found out he entered your land to order you off without a warrant or your permission [:)]. A nice policeman would be welcome to stay [:D].

Sincerely,
Daniel Parks

Is a quasi-governmental entity like Chicago’s Metra considered public or private? Am I a “shareholder” by virtue of paying the six-county sales tax that subsidizes the trains? Would I be in a better position to argue with transit cops if I had a return ticket in my pocket? I realize Metra cops seem to have gone way over from time to time, but it would be nice if I knew my rights and wasn’t simply bluffing. It seems to me the people who don’t know where they stand are the most insecure and then the most likely to “act out” in the presence of authority.

Opinions, legal theories, experiences, etc all welcome.
