Teenage rail photographer suing for 2011 arrest

“as long as there is no trespass.”

Sue the hell out of those mother ----ing cops. Good Luck!!

Another victim of big over-reaching socialist government. There is something very wrong when government can’t tell the difference between normal Americans and terrorists. On the other hand, get used to it. The regime is only going to make it much worse.

Go after them, get as much as you can and more.

Good for him. The arrest was a typical Nazi-like, right-wing response to being given a little power. It’s police figures like that need to be watched.

I have actually seen the footage of the arrest taking place and what not, and what the enforcement people did was wrong and VERY unprofessional, best of luck!

I presume Mr. Guse means the Bush regime, which passed the Patriot Act.

Amazing that the suit was filed after Steve Barry won his case. That probably emboldened some lawyers to go after all the deep pockets.
Regarding overzealous cops, they are there supposedly enforcing many different aspects of the laws of the land. The training of law enforcement folks needs as much review and revision as do gun laws.
Finally, I think it is Mr. Guse who references “noramal Americans” and “terrorists.” Seems like Mr. McVeigh was considered a normal American, but he still blew up the Federal Center in Oklahoma. That was a terrorist act in my book.

The nation’s rails are covered in grafitti. Yet, when is the last time you’ve read a story about vandals being detained? Why is it always the photographer?!

Good for him. Probably won’t go to court but will settle to avoid embarrassment. I also noticed Steve Barry editor of a rival Railfan magazine won his lawsuit against another transit company for his arrest. Maybe this will turn things around.

@ Guse: since when did the Republican former President Cheney and his puppet side-kick, George Bush, run a socialist government?? All the “terrorist paranoia” happened during their terms. Guse, get your facts and time-line straight!!

Since when is Nazi right wing? I thought is was a socialist party!

Last summer I was in my old stomping ground of Selkirk NY (old Perlman Yard) and wanted to recreate some shots from the 70’s from a road that used to run over the engine service area. Road is now closed to traffic. Stopped by CSX office on a weekday which was locked up tight, couldn’t find any employees to ask questions. Basically no access around Selkirk. Stopped by the local police station and they said they routinely get calls from CSX to roust photographers. Police dispatcher told me it was illegal to photgraph trains. I responded that this was not the case under the Patriot Act. Funny thing is I grew up here, new a lot of the officers and in fact ran fire and EMS in the area in the 70’s

While the keystone cops are harassing this poor kid gangbangers are graffiti painting the boxcars right under their noses.

I wish everyone nothing but the best of luck when suing whomever harrasses them for just simply photographing something. As long as noone is actually trespassing where they shouldn’t be in the first place and endangering themselves or anyone else, we know that such harrassment’s wrong and the agenies, authorituies and railroads involved need to have the living HELL sued out of them for this.

I agree with Mr Barnes railroads should be happy for the extra eyes and ears out along the line

WHY IS IT ALWAYS THE LOCAL POLICE THAT WE ALWAYS HEAR ABOUT HARASSING RAILFANS… NEVER THE RAILROAD SECURITY/POLICE…,…MAYBE THE RAilROAD POLICE NEED TO HOLD CLASSES FOR LOCAL LAW ENFORCEMENTS.
