I wonder if EHH and Ackman know that they would lose a proxy fight and are just trying to find a graceful way out of the whole thing?

Jacquie McNish at DowJones is reporting that CP is abandoning the proxy battle, but will instead be ssubmitting a proxy resolution that would seek support from shareholders to nudge Norfolk Southern to enter merger discussions.
