UP sues MTH

Did you see the article on page 8 of the Apri MRR? Union Pacific sues MTH over licensing. Woderful part in it that states, ‘the lawsuit requests that MTH stop using its trade marks, sends its UP branded products to the railroad to be destroyed and pay the railroad for lost revenue and damages.’
This is too subtle to be an April Fool’s joke.
Gosh, MTH… reap what you sow springs to mind!

Up has gone down the hill. All they car about is the money. they hit everyone, And whats so funny is loss of revenue from what? This shipper stopped shipping cause of MTH? or loss of their precious tradmark because everyone else pays for it. I remember longtime some old timer said it aint what it use to be. The railroads use to not care about the money from Model trains cause it was free publicity. Now its I got to have all the money in the world and if they arent with us we will take them down. I say screw UP I stopped buying items marked for them about 2 yrs ago. A million dollar or more Railroad moaning about the little they lost from Model Railroad companies what is this world coming to…UP means Ulitmately Pathetic in my opinion.

A silly lawsuit that won’t go anywhere.

Actually, I wish ALL of UP’s lawsuits against model manufacturers wouldn’t go anywhere! Or maybe I remember the good old days when railroads like New York Central and Santa Fe actually PAID Lionel to put their color schemes on O-gauge F3’s.

Those were the days when railroads took pride in their fleet and used the models to get their name to the public. Santa Fe really knew how to get out the message by putting their name on the Lionel model trains. Most kids would want to ride the Super Chief for sure if they were going to California from Chicago. I don’t remember the Zephyr getting the same press or word of mouth like the Super Chief., but they probably got their message out in a different way.

None of the freight railroads really care if we show up or not to watch them.

Interesting enough about Railroads HELPING the model/toy industry.

If you had an A.C. Gilbert Erector Set as a kid - it was modeled after the NEW HAVEN’s metal “lattice” catenary towers in the electric zone.

If you had an A.C. Gilbert American Flyer passenger train, that turtle roof design was modeled after the New Haven Pullman-Bradley coaches.

There’s more I can’t think of right now, like the NH Society of Model Engineers, and other things the real New Haven railroad approved of.

Well, this has been discussed before, but if there’s interest in it…

Anyway, UP is not showing any bias here. Though most of us don’t agree with the way they handle this, it is still their right. MTH had an advantage in that they obviously read that UP went after AThearn. After that occured, Mike Wolf should have immedietly taken the steps to avoid UP coming after his company. From what I’ve read before, a dialogue was established between MTH and UP’s reps. Apparently MTH was stonewalling and UP decided not to play the game and filed the lawsuit.

UP can afford a hotshot legal team. Can MTH? Especially now that MTH is struggling financially?

It’s doubtful UP will attempt to wipe out MTH. Model manufacturers like Athearn, MTH, and Walthers are small pototoes for a giant corporation. More than likely a settlement and a very long, written trademark agreement will be the result as was with Athearn. Will it cost MTH? More than likely.

This is about the trademarks, nothing more. Hopefully UP’s future management team will do a better job, public relationswise, with model manufacturers (and Amtrak). But remember, UP is already shining like a rose in other areas. The UP sponsered trip with the Boy Scouts a couple of months back caught a lot of postive publicity. Those well educated UP executives are not that stupid.

As for UP bashing on this forum…what does it accomplilsh? I like and respect the UP of the past. I don’t like the current UP management. But it’s unfair to say we “hate a railroad” when thousands of that railroad’s employees are hardworking dedicated men and woment.

A mechanic that I worked with at a transit authority years back, moved to the West Coast to work for UP as a locomotive engineer. Last I heard, he was quite happy.

Well, UP certainly has the right to wipe out any crooked purveyor of models of their paint schemes. God-knows how many millions of dollars UP has lost because misguided customers unwittingly attempted to ship their goods on model trains and then complained to all of their golf buddies how lousy UP was as a shipper…
