He couldn’t see a train? Did he have his headlights on? Come on! It’s not like they’re easily concealable. I guess common sense really isn’t that common anymore…
Okay, did he not have his lights on? And, if he just saw the road, and nothing more, it sounds like there were no other cars, don’t people normally put on their High-Beams? And locomotives usually reflection stickers all over the sides and front, did he not see them. I don’t think he should drive a car, if he can’t see a locomotive.
I keep trying to tell everyone that! No common sense and no common courtesy any more! Me first, Me only and Duh!
Looking at the photograph, I can see the locomotives quite clearly.

Were his lights off or his eyes closed? jerk his license and make the road just a bit safer. And he should have to pay the railroad for there losses.
My friends are always astonished that this sort of thing happens - how can anyone fail to notice a train? Would he complain if he misread a bend and crashed into a wall or some other obstacle? Think this one goes down as “Driver error: doesn’t look beyond own front bumper”

Say what you will about this, sometimes when the weather is bad (foggy, rainy, snow, etc.) and you come upon a crossing that has no flashing lights or gates and there is a train on the track it is not always easy to see the train…THIS IS WHY THE FEDS ARE NOW REQUIRING RAILROADS TO PUT REFLECTIVE TYPE TAPE ON ALL LOCOS AND CARS, SO WE CAN EASILY SEE THEM AT NIGHT. All of this aside, if you have half a brain you will certainly slow down when you see the crossbucks and to be sure if there is a train there. Anybody who does not slow down or stop at a crossing to be sure is just plain dumb.
One last thing to add, if you happen to read the article in the link shown above you will see that the engines are red (hard to miss in your headlights on a clear night like that one) and if you read the quote of this guy Oscar Duncan you will have to come away with the idea he is dumber than a box of rocks if the quote is totally accurate (I am referring to his butchering of the English language).

Good grief! What we have here are three cases that prove beyond a shadow of doubt that we are legislating our species into oblivion. Three proofs that our genetic pool is horribly polluted. Every time I pass an old couple doing 30 mph in a 65 mph zone, I realize there’s probably some son or duaghter up north bragging that their folks “are really independent down in Florida…”

I’ve got an interesting question. I know that when a train hits a vehicle the crew has to be relieved to take drug & alcohol tests. Now if the vehicle hits the train does the crew have to take the tests even though it looks like the driver of the vehicle should be taking the tests?
And yes, I’m guessing the railroad will be held liable because some smart lawyer will note that the gates weren’t down and the lights weren’t flashing, there was no flagman, etc.
Of course, the railroad could be a smart-*** and say that the engine was on the crossing because their boyfriend pushed them onto the crossing.

Flares, reflective tape, and locomotive lights notwithstanding, take another look at the locomotives. Below the walkway - black. Above the walkway - red, which turns black in the dark (a well known fact of color recognition). While I won’t condemn the RR - like the article said, they had flares out, I can’t completely fault the driver. His low beams would have been hitting below the walkway. And the flares may have actually obscured the train.
Then, again, he probably should have seen that reflective OLS sign on the engine nearest the camera…
We had a case here in Central PA within the last few weeks where two teenagers were killed when they drove into the side of a train that was occupying a crossing… and here’s the kicker… THE CROSSING WAS PROTECTED BY LIGHTS THAT WERE ACTIVATED AT THE TIME!!! Not surprisingly, there was alcohol and excessive speed involved.
