Based on the title of this thread, I was expecting to read a link where a person represented themselves and was out maneuvered in the courtroom by the legal team of a railroad. Not a case where the suit was ordered dismissed as being without merit or cause.

You should have included the line drunk as a skunk. .198 BAC is legally under the influence in any state of the union. My sympathies lie with the motorman who more or less had a front row seat and could do no more then to watch. Rgds IGN

The contributory actions leading to the ‘trauma’ suffered by the plaintiff were entirely autonomous, including his trespass onto property to which the NYCTA/People of NYC are in law intended to enjoy exclusive right. We might as well start court cases where gun manufacturers are sued by the estates of those who use their products to commit suicide.

…which, I am sure has been done. Maybe even successfully.

Which reminds me…I wonder if a complainant/plaintiff has successfully sued for ‘trespass’ against the RR for sound incursion, either ambient operating noise or whistles/horns.
