Your tounge in cheek pictorial satire is superlative! I wonder if they all were taped up at point of packaging, would the Ultimate Pennypinchers still be able to collect? Then they guy at home could take the tape off (unbeknownst to the manufacturer or retailer) and screw them out of the ill gotten loot.

I just wish UP would embrace the free promotion… Marty write UP and ask them if they would like to fly their colors and logo for a fee on your layout[:D]

I don’t know if any of you receive Left-wing e-mail urging you to write to your representatives about a number of issues that they feel the Right is doing to harm us (Tom DeLay, Karl Rove, The Patriot Act, Social Security etc, etc). Apparently these letter-writing campaigns are proving to be quite successful. Maybe we should start a campaign of our own aimed at the UP. Letters to newspapers, potential shippers, LS retailers, manufacturers, etc. with copies to the UP board might make them squirm a little.

One major difference between Congress and the UP–we don’t elect the UP board. Since we’re neither customers nor shareholders of the railroad, they have little–if any–incentive to care how they look to the general public. Funny, as much as I think the recent $11 million verdict against them was excessive, there’s a big part of me that smiles and says “you reap what you sew.”
Perhaps we could convince Kalmbach to launch a hostile takeover bid… [}:)]

So while you are putting UP in a special spot on your mantle, why not go after every large corporation in this country that has fought for trademark rights? Seems to me like making UP out to be something special in this regard is kind of ridiculous, but to each his own I suppose… [;)]

I have to agree with Marty, how long before Uncle Pete sends his Stormtrooper lawyers the Nebraska? After all, Marty has had his layout in GR, on the MLS calender, and on these forums, most often with legitimantly purchased Aristo and USA items with UP livery on promanant display, it doesnt matter that Marty purchased them for his own personal use, it doesnt matter that he’s just a hobbiest who likes to share uncannily reaslitic pictures of his trains on his layout, hes not making a dime off of his pictures, UP’s lawyers will just see there logo being displayed without them getting their “Protection Money”, their “Cut”.
Going after model makers is one thing, but when they start going after guys who take photos for calanders (happened in Canada) whats next? Are they going to start going after guys who simply show photos of legitamitly purchased models on websites or magazines? Will it get that seriously stupid? Knowing UP’s crack legal team and their past actions, YES! It fear it will!

I’ll stand by you Marty, lawyers don’t scare me. Something about the first amendment… If they display a copywrited logo on thier equipment, then put that equipment on public display, then they are opening themselves up to having that logo displayed on public forums, such as the newspaper and TV.
By placing said logo on merchandise for public purchase, it is understood that they then have no control over further use of the item, in other words, they got thier money once at the time of purchase. If a logo bearing item subsequently apears in a photo such as ones that Marty takes, then it’s too bad for the UP.
To gain the level of control over thier logo that the UP seems to want, then the UP needs to cover all thier equipment with DUCK TAPE, not the modeler.[soapbox]

Please people, why don’t you pick on Amtrak, or CSX? They charge for licensing. UP is one of the most successful railroads they are doing something right. Why do you hate them?
UP is not alone on this most companies would sue you for making money on their name and logo. Try it and find out.
I don’t think anybody has an agenda against UP, they are just in the forefront at the moment so naturaly conversation would revolve around this company. What they are doing is no different than most other companies have a HISTORY of doing. In the model RR field, I think Chessie caused a stir about 20 years ago, but most roads like the free advertising models of thier equipment get. This will blow over in a short time as they all do.
Ian, in defence of Marty and North American RRs, we don’t get much news on this side of the pond about similar circumstances in Europe. I for one am interested in the rest of the world and the goings on of foreign companies as they will eventualy affect what we do here. If you have any news to share, then please post it so we can all learn and be better for it. Does British Rail and others do this sort of thing?
