whos gonna win?

A new industry is coming to town.CSX is working with the county to build a new rail spur.The little Maumee and western says not so fast.The problem is the Maumee & Western track is out of shape and they dont have the crossover anymore south of town.Csx says the crossover wasnt being maintained so who wins? will M&W get trackage rights?time will tell.

Thats like trying to take someone’s yard because they don’t use it enough. Can they really take over even if it isn’t thiers to take?

Is the switch coming out of CSX owned track to serve the industry.??? If so, Maumee & Western does not have a prayer. If not, PUCO and STB will weigh-in along with the Ohio Rail Development folks…What’s where and in relation to what???

the industry will be located right between both rrs.thing is the M&W has been out of shape west of town.CSX even took out the crossover because their track wasnt being maintained.(think its still in embargo status).hope this helps

I read the STB filing on this one…it could get interesting. Either railroad could serve this industry, as the tracks of both are close to it. The M&W is actually at the same grade level as the industry; CSX would have to descend a grade to get in. CSX wants to serve it because the M&W track is out of service; the M&W track is out of service because CSX removed the M&W diamonds (it’s a crossing, not a crossover) and straight-railed their track there, effectively severing the M&W main line.

Here’s the interesting part…M&W says its line was there first, so CSX has to pay for and maintain the crossing. M&W wants CSX to restore the diamonds, and pay the upkeep. If CSX refuses, M&W wants STB’s permission to sever CSX’s main line at that point and rebuild its own line through there!

Like I said, this could get interesting!

…Boy that does sound like an interesting one shaping up…and on the surface, one would think the B&O would have been the earliest, but that’s just judging from history and the B&O’s age.

B&O’s history is in the East.

I don’t believe they began to build West from Chicago Jct. (Willard) until about 1875 or thereabouts, and that building was from a junction for the line that ran from Wheeling, through Columbus to Sandusky. (ie. Chicago Jct.)

I’m not a lawyer, but I think the M&W is making a great argument. I wouldn’t be at all surprised if they win and make CSX restore the diamonds, and subsequently win the service contract. The way I see the evidence, CSX made a unilateral move to simplify their own operation, as the M&W wasn’t actively using the track. To the M&W’s credit, they complained and went on record quickly after CSX cut them off.

To Mr Love, I don’t live anywhere near there, or have any particular attachment to either railroad in question, but I still find the story interesting. I know it is difficult, but sometimes no comment is the best thing to make on a topic.

thanks for the info.the B&O didnt reach Chicago until 1874(according to classic trains timeline). had to rebuild after the civil war and the politicians in the prrs pockets werent helping.MR.LOVE to answer your comment it just proves what we do now does affect the future.look at your sante fe.if things turned out diffrently the drgw could have been in california.

Fair play to the STB though, the thing was only filed just over a week ago and it’s on their web site already.

I would think that the company would want access to both railroads.

Do what Minnasota Corn processors did here in NE, They are on the Union Pacifics Overland Route Through Columbus, but they had then at the time BN keep one of there branch lines that cuts across twenty some miles of branch line 5-10 mph trackage to get there. What this does? It lowers the rates they use. If they feel one is being too high, they just turn around and use the other railroad in return.
